British Visa help req...
Posted by sk76 (42 days ago)
Hope someone can help with this scenario:
British national married to pakistani man, who is a HK perm resident.
They now wish to live perm in the UK.
Can the woman who lives/works in HK apply for this whilst still living/working in HK or does she have to be in the UK in order to do this.
The man has already been granted a visit visa which is still valid for another 4 months - should they apply straight away or wait for the visit visa to expire...will this impact their case in anyway??
Have already been on the website and found it confusing plus sent an email to the equiry id but as of yet have not had a response.
Any helpful suggestions gratefully received as the woman now desperately wants to go home but not without hubby.
Ta :)

Why not just go to British Consulate and fill up the settlement visa form and hand it to the visa officer in charge, then you will know exactly if you can apply for settlement visa for your husband, if can do, they will inform you what other documents needed to support his application.

For your information,
The British wife can apply the husband as her dependant and can try settlement visa. I applied two years ago and was granted for settlement visa. The job offer from U.k. helped a lot because it means my British husband for sure has job waiting for him.
When we applied for my Settlement visa from Hong Kong British Consulate, my husband gave a supporting letter confirming that he is responsible for me financially, gave the copy of U.K. job offer and bank statement. He was interviewed for just few minutes and paid few thousand dollars and very quick to grant my settlement visa. I am Filipina by the way.
If the settlement visa is sticked to your passport, there is an attached paper informing that I have to renew my visa one month before expiration, I am allowed to work freely but I am not allowed help from public funds
Actually, at first, when my husband resigned from his Hk job, my husband decided to go back to U.K. Without job offer from U.K., He tried to apply for my settlement visa, but the British Consulate was concerned about our accomodation because my husband told them that while we are not yet settled in U.K., we have to stay with my step son. So they want us to provide more supporting documents about the accomodation. Luckily, my husband got the U.k. job offer which made everything easier.
We are still in Hong Kong because my husband is used to the HK life and we might retired in Phils and Hk in the near future.
By the way, I have good comment, the British Consulate staffs in Hong Kong are efficient, polite and more straight forward.
Good Luck

The British national is entitled to apply for a dependant visa for her husband to enter and stay in the UK whilst both are in H.K., once the visit visa expires.

So, they can only apply once the visit visa expires???
OK, this is just confusing as they've been told that they can apply straight away by someone else, even if his visit visa isn't expired!
Anyone else have some wisdom or personal experience to share!
